JOB TITLE:  Deputy Clerk - Civil Division


DEPARTMENT: Magistrate Court, Ware County


JOB SUMMARY: This position is responsible for receiving and processing civil suits and providing general clerical support to the court.



  • Assists the general public by telephone and in person with the filing of civil suits by providing information on the filing process and answering other questions related to court business.
  • Processes and types civil suits, including dispossessory, garnishment, foreclosure and writ of possession cases: receives payment for services, writes receipts, prepares cases for service by the Sheriff's Department, posts and files all related documents, and types judgments.
  • Types Fi Fa's and transfers same to the Superior Court for processing.
  • Issues writs of possession and default judgments; sets up consent judgments on claims.
  • Files answers on cases received from attorneys and defendants, sets hearing dates, prepares court calendars, types subpoenas, and files appeals.
  • Attends civil court hearings: records hearings, maintains a log of court tapes, types judgments and mails copies to involved parties.
  • Accepts, receipts and posts monies received for filing fees, fines, and payments on judgments.
  • Assists with such general office duties as processing daily mail, typing and filing documents, and maintaining court files.
  • Prepares civil caseload reports each quarter.
  • Assists with the work of other Deputy Clerks as needed.
  • Performs other related duties as assigned.
  • Knowledge of modern office procedures.
  • Knowledge of the functions and procedures of the Magistrate Court.
  • Knowledge of applicable state laws and county ordinances.
  • Knowledge of bookkeeping and accounting practices.
  • Knowledge of court procedures and legal terminology.
  • Skill in operating such office machines as a computer, fax machine, calculator, and copier.
  • Skill in performing basic mathematical calculations.
  • Skill in dealing with the public.
  • Skill in oral and written communication.


SUPERVISORY CONTROLS: The Clerk assigns work in terms of somewhat general instructions. The supervisor reviews completed work for accuracy and the nature and propriety of the final results.


GUIDELINES: Guidelines include the Official Code of Georgia Annotated, Magistrate Court rules, and county policies and procedures. These guidelines are clear and specific, but require some interpretation in application.


COMPLEXITY: This position consists of related clerical and administrative tasks. Frequent interruptions contribute to the complexity of the work.


SCOPE AND EFFECT: The purpose of this position is to provide administrative and clerical support to the court. Successful performance helps ensure accurate financial and case records.


PERSONAL CONTACTS: Contacts are typically with co-workers, the general public, law enforcement officials, attorneys, judges, collection agency representatives, and local business owners.


PURPOSE OF CONTACTS: Contacts are typically to give or exchange information, and provide services.


PHYSICAL DEMANDS: The work is typically performed with the employee sitting at a desk or table.


WORK ENVIRONMENT: The work is typically performed in an office.

  • Ability to read, write and perform mathematical calculations at a level commonly associated with the completion of high school or equivalent.
  • Sufficient experience to understand the basic principles relevant to the major duties of the position usually associated with the completion of an apprenticeship/internship or having had a similar position for one to two years.
